Cairnova Commerce Ltd ("Cairnova", "we", "us", "our") is a Scottish outdoor brand providing technical apparel, live mountain and trail intelligence, night sky data, a walking club directory and community features for Scotland's hillwalking community.

We are incorporated in Scotland and operate from Clyde Offices, 2nd Floor, 48 West George Street, Glasgow G2 1BP.

By accessing or using cairnova.co.uk you agree to be bound by these Terms in full. If you do not agree, you must not use this website.

Field Intelligence Platform. Live and forecast weather conditions, route data and environmental information for Scottish Munros and trails updated daily. This includes Mountain Intelligence, Trail Intelligence and Night Sky Intelligence.

Community Features. A walking club directory listing third-party clubs across Scotland, an events calendar and a community photo and video submission system.

Apparel. Technical outdoor clothing and accessories, including the Saltire Cairn trekking sock, available for purchase through cairnova.co.uk.

Weekend Mountain Briefing. A free weekly email publication providing mountain conditions, dark sky forecasts and outdoor news for Scotland.

All weather, conditions and forecast data displayed on our platform is sourced from third-party providers including Open-Meteo and NOAA. Cairnova does not own, generate or guarantee the accuracy of this data.

Mountain, trail and night sky conditions can change rapidly and without warning. Data displayed on our platform may not reflect real-time conditions at the time of your visit to any location.

Route information, distances, ascent figures and timing estimates are provided as general guidance only. Individual experience, fitness, equipment and conditions on the day will materially affect actual outcomes.

Cairnova accepts no responsibility for any loss, injury, death or damage of any kind arising from reliance on any data, information or content published on our intelligence platform.

You are solely responsible for your own safety and the safety of any members of your party when undertaking any outdoor activity. Always carry appropriate equipment, check multiple weather sources, file a route plan and exercise personal judgement.

All product descriptions, materials specifications and sizing information are provided in good faith. Cairnova makes no warranty that products will be suitable for any specific activity or conditions.

Cairnova apparel is designed for outdoor use in Scottish terrain conditions. It is not certified safety or protective equipment. You assume all risk associated with the use of our products in any outdoor activity.

Returns and refunds are handled in accordance with your statutory rights under the Consumer Contracts Regulations 2013 and the Consumer Rights Act 2015. For returns enquiries contact team@cairnova.co.uk.

Prices are displayed in pounds sterling (£) inclusive of VAT where applicable. We reserve the right to change prices at any time without notice prior to your order being confirmed.

The Cairnova Club Directory lists walking clubs and organisations submitted by third parties. Cairnova does not vet, endorse or take responsibility for any club, organisation or event listed in the directory.

Clubs and events are listed for community information purposes only. Cairnova makes no warranty as to the accuracy, safety standards or suitability of any listed club or event.

Any participation in events or activities organised by third-party clubs listed on our platform is entirely at your own risk and subject to the terms and conditions of that club or organisation.

By submitting an event for listing on Cairnova — whether through our events page submission form or our general contact form — you confirm that you have the authority to submit that event on behalf of its organiser, and you grant Cairnova permission to use and publish the details you provide, including the event name, date, location, description, category, organiser or business name, and any price or ticketing information, on cairnova.co.uk and our associated marketing channels.

You further consent to Cairnova supplementing your submission with publicly available information about the event or its organising body, sourced from the organiser's own website or public social media channels, where reasonably necessary to keep a listing accurate, complete or up to date.

Personal contact details (such as your name and email address) provided as part of an event submission are used internally for moderation and communication purposes only, and are not published as part of the public listing.

Cairnova welcomes photo and video submissions from walkers, hillwalkers and outdoor adventurers across Scotland. By submitting any photograph, video, or other visual asset to Cairnova through any submission form, email or social media channel, you confirm that you are the original creator of that content and hold full copyright over it, or that you have obtained all necessary rights and permissions from the copyright holder to submit it.

Standard submission licence. By ticking the consent checkbox on our submission form — which links to these Terms — and submitting your content, you grant Cairnova a non-exclusive, royalty-free, worldwide licence to use, reproduce, publish, display and distribute your submitted content as a genuine community feature: featuring your work in the Cairnova Adventure Gallery on cairnova.co.uk; including your content in the Weekend Mountain Briefing email newsletter; and sharing your content as an organic post on Cairnova's Instagram, Facebook and any other social media channels operated by Cairnova Commerce Ltd. Full credit — including your name and, where provided, your Instagram handle — will be given on every use of your content under this clause. This clause does not cover use of your imagery within paid advertising or promotional campaigns, including campaigns distributed via social media platforms, which is addressed separately in Clause 6.3.

Extended asset and promotional use licence. The same consent given under Clause 6.2 also grants Cairnova a non-exclusive, royalty-free, worldwide licence to use your imagery more broadly — including as background photography, section imagery or promotional material on cairnova.co.uk, and within paid advertising or marketing campaigns run by Cairnova on any platform, including paid campaigns on social media. This is distinct from the organic community feature use described in Clause 6.2, even where the same platform (such as Instagram or Facebook) is involved. Credit is always guaranteed for use within the Adventure Gallery, as set out in Clause 6.2. For any other use of your imagery under this clause — including website assets and paid advertising — credit is not guaranteed, although we will provide it wherever reasonably practicable in the design or campaign context. There is no separate checkbox for this licence — agreeing to these Terms at the point of submission covers both Clause 6.2 and Clause 6.3 together.

Neither licence granted under clauses 6.2 or 6.3 constitutes a transfer of copyright. You retain full ownership of your content at all times. Cairnova will not sell, license or transfer your content to any third party for commercial purposes without your separate, explicit written consent.

You may withdraw your licence at any time by contacting team@cairnova.co.uk. On receipt of a withdrawal request, Cairnova will remove your content from active use on our website, gallery and newsletter within 30 days. Content that has already appeared in published newsletter editions or archived social media posts cannot be retrospectively removed from those records, but will not be used in future publications following withdrawal.

Cairnova reserves the right to decline, remove or not publish any submission at our sole discretion and without obligation to provide explanation. We will not publish content that is offensive, misleading, in breach of third-party rights, or inconsistent with the Cairnova brand and community values.

By submitting content you confirm that: your submission does not infringe the intellectual property rights, privacy rights or any other rights of any third party; no identifiable individuals appear in your submission without their consent; and your submission does not contain any unlawful, defamatory or harmful material.

To the fullest extent permitted by law, Cairnova Commerce Ltd, its directors, employees, partners and agents exclude all liability for:

Nothing in these Terms limits our liability for death or personal injury caused by our own negligence, fraud, or any other liability that cannot be excluded by law.

Where liability cannot be excluded, our total liability to you in connection with any claim shall not exceed the amount you paid to us in the 12 months preceding the claim, or £100, whichever is greater.

All content on cairnova.co.uk — including text, imagery, brand assets, intelligence data presentation, design and code — is the intellectual property of Cairnova Commerce Ltd unless otherwise stated.

You may not reproduce, distribute, modify or commercially exploit any content from our website without our prior written consent.

The Cairnova name, logo and brand marks are proprietary to Cairnova Commerce Ltd. Unauthorised use is strictly prohibited.

Copyright in the original design, source code, layout, structure and written content of cairnova.co.uk arises automatically upon creation under the Copyright, Designs and Patents Act 1988, and subsists whether or not formally registered or marked with a copyright notice. This Clause 8.4 is provided for clarity and as an additional express statement of that automatic protection — it does not create any right that does not already exist in law.

Cairnova Commerce Ltd is the owner of that copyright. Any unauthorised copying, scraping, reproduction, adaptation or repurposing of our website's design, source code or original content — in whole or in part — without our express prior written permission may result in legal action to protect our rights.

All rights not expressly granted to you under these Terms are reserved by Cairnova Commerce Ltd.

Our Privacy Policy, available at cairnova.co.uk/privacy, explains how we collect, use and protect your personal data. By using our website you agree to the terms of our Privacy Policy.

We use session data and analytics to improve our services. We do not sell your personal data to third parties.

Our website may contain links to third-party websites and services. Cairnova is not responsible for the content, accuracy or practices of any third-party website.

Weather data is provided by Open-Meteo (open-meteo.com) and NOAA. Aurora and geomagnetic data is provided by the NOAA Space Weather Prediction Center. Cairnova does not warrant the accuracy of data provided by these services.

Individual event pages include an embedded Google Maps view of the event location. Location markers are generated automatically from the location text provided at submission, and Cairnova does not warrant the accuracy of the map, the pin placement, or any information displayed by Google's mapping service.

We do not guarantee that our website or any service will be available at all times. We may suspend, withdraw or restrict access to any part of our website for operational, business or security reasons without notice.

Intelligence data is updated on a best-efforts basis. We do not guarantee the frequency, timeliness or continuity of data updates.

We reserve the right to update these Terms at any time. Changes will be published on this page with an updated effective date. Your continued use of our website following any changes constitutes acceptance of the revised Terms.

We recommend checking this page periodically. Significant changes will be communicated via our newsletter where possible.

These Terms are governed by and construed in accordance with the laws of Scotland. Any disputes arising from these Terms or your use of our website shall be subject to the exclusive jurisdiction of the Scottish courts.
