Cairnova Commerce Ltd ("Cairnova", "we", "us", "our") is a Scottish outdoor brand providing technical apparel, live mountain and trail intelligence, night sky data, a walking club directory and community features for Scotland's hillwalking community.

We are incorporated in Scotland and operate from Clyde Offices, 2nd Floor, 48 West George Street, Glasgow G2 1BP.

By accessing or using cairnova.co.uk you agree to be bound by these Terms in full. If you do not agree, you must not use this website.

Field Intelligence Platform. Live and forecast weather conditions, route data and environmental information for Scottish Munros and trails updated daily. This includes Mountain Intelligence, Trail Intelligence and Night Sky Intelligence.

Community Features. A walking club directory listing third-party clubs across Scotland, an events calendar and a community photo and video submission system.

Apparel. Technical outdoor clothing and accessories, including the Saltire Cairn trekking sock, available for purchase through cairnova.co.uk.

Weekend Mountain Briefing. A free weekly email publication providing mountain conditions, dark sky forecasts and outdoor news for Scotland.

All weather, conditions and forecast data displayed on our platform is sourced from third-party providers including Open-Meteo and NOAA. Cairnova does not own, generate or guarantee the accuracy of this data.

Mountain, trail and night sky conditions can change rapidly and without warning. Data displayed on our platform may not reflect real-time conditions at the time of your visit to any location.

Cairnova digitally mapped route guidance. Route lines and GPX files are independently prepared using publicly mapped paths, geographic mapping data and route-planning references. They have not been walked or field-verified by Cairnova. A displayed line does not confirm that a continuous, accessible or safe path exists, and some sections may cross pathless, steep, exposed or technically difficult terrain.

Route information, distances, elevation gains, profiles and timing estimates are provided as general planning guidance only. They may contain inaccuracies and can be affected by mapping resolution, route interpretation, terrain, detours and conditions. Paths, access arrangements and ground conditions can change without notice.

Before setting out, independently examine the complete route against a current detailed map; check weather, daylight, access restrictions and known hazards; and assess whether the route is appropriate for your party. Carry an appropriate map and compass and know how to use them. Do not rely solely on Cairnova, a GPX file, a mobile phone or any single electronic navigation device.

Downloading a GPX file does not constitute a recommendation that you undertake the route. You remain responsible for route choice, navigation, preparation, equipment and decisions made before and during the activity. Be prepared for conditions worse than forecast, alter your plans when necessary and turn back when conditions, capability or safety require it.

Where a route carries an additional checking or estimated-route notice, this identifies known uncertainty in the supplied route information. The absence of such a notice does not mean that a route has been walked, independently verified, certified or confirmed safe by Cairnova.

If you become aware of a material route, summit, access, mapping or safety issue, please report it to [email protected]. Cairnova may amend, suspend or remove route information while a report is reviewed.

GPX download acknowledgement. Before downloading a GPX file, you are asked to confirm that you understand the route data is digitally mapped planning guidance, has not been walked or field-verified by Cairnova, and may contain inaccuracies, gaps or pathless sections. You must cross-check the route against a current detailed map, carry a map and compass and know how to use them, and check current weather, daylight and access conditions. You also confirm that you have read and agree to these Terms, including this Intelligence Data disclaimer. You remain responsible for your route decisions, navigation, preparation and safety. These acknowledgements do not waive your statutory rights or exclude any liability that cannot lawfully be excluded, as explained in Clause 7.2.

Downloaded files and navigation devices. A downloaded GPX file is a copy of the route information available when downloaded; it does not automatically receive later corrections. Check for updated guidance before use, and check that the full route imports and displays correctly on your chosen app or device. Device compatibility, GPS reception, battery life and offline map availability can affect navigation. A gallery photo, map pin or suggested place name is not a verified route or evidence of safe access.

All product descriptions, materials specifications and sizing information are provided in good faith. Cairnova makes no warranty that products will be suitable for any specific activity or conditions.

Cairnova apparel is designed for outdoor use in Scottish terrain conditions. It is not certified safety or protective equipment. You assume all risk associated with the use of our products in any outdoor activity.

Returns and refunds are handled in accordance with your statutory rights under the Consumer Contracts Regulations 2013 and the Consumer Rights Act 2015. For returns enquiries contact [email protected].

Prices are displayed in pounds sterling (£) inclusive of VAT where applicable. We reserve the right to change prices at any time without notice prior to your order being confirmed.

The Cairnova Club Directory lists walking clubs and organisations submitted by third parties. Cairnova does not vet, endorse or take responsibility for any club, organisation or event listed in the directory.

Clubs and events are listed for community information purposes only. Cairnova makes no warranty as to the accuracy, safety standards or suitability of any listed club or event.

Any participation in events or activities organised by third-party clubs listed on our platform is entirely at your own risk and subject to the terms and conditions of that club or organisation.

By submitting an event for listing on Cairnova — whether through our events page submission form or our general contact form — you confirm that you have the authority to submit that event on behalf of its organiser, and you grant Cairnova permission to use and publish the details you provide, including the event name, date, location, description, category, organiser or business name, and any price or ticketing information, on cairnova.co.uk and our associated marketing channels.

You further consent to Cairnova supplementing your submission with publicly available information about the event or its organising body, sourced from the organiser's own website or public social media channels, where reasonably necessary to keep a listing accurate, complete or up to date.

Personal contact details (such as your name and email address) provided as part of an event submission are used internally for moderation and communication purposes only, and are not published as part of the public listing.

Cairnova welcomes photo and video submissions from walkers, hillwalkers and outdoor adventurers across Scotland. By submitting any photograph, video, or other visual asset to Cairnova through any submission form, email or social media channel, you confirm that you are the original creator of that content and hold full copyright over it, or that you have obtained all necessary rights and permissions from the copyright holder to submit it.

Community submission licence. By giving the separate community publication permission on the form and submitting content you have the right to share, you grant Cairnova a non-exclusive, royalty-free, worldwide licence to reproduce, publish, display and distribute it as a community feature in the Adventure Gallery, the Weekend Mountain Briefing newsletter and organic posts on Cairnova social media channels. Gallery publication includes your credit, caption and selected location, including exact map coordinates. Community features are credited using your name or supplied Instagram handle. This licence does not include the additional uses in Clause 6.3.

Optional website and promotional licence. Only if you tick the separate optional checkbox, or subsequently give specific permission, you also grant Cairnova a non-exclusive, royalty-free, worldwide licence to use your submitted photo or video as general website imagery and in paid advertising or promotional campaigns, including social media ads. This choice is unticked by default and is not required for a gallery submission. Credit may not appear in these additional uses. Agreeing to these Terms alone does not grant this additional permission, and an older submission without a separate permission record is not treated as opted in.

Neither licence granted under clauses 6.2 or 6.3 constitutes a transfer of copyright. You retain full ownership of your content at all times. Cairnova will not sell, license or transfer your content to any third party for commercial purposes without your separate, explicit written consent.

You may withdraw either permission by emailing [email protected]. We will stop the relevant future use and remove active Cairnova-controlled placements without undue delay, subject to applicable legal requirements. We can remove our website content and social posts, but cannot recall delivered newsletters or guarantee deletion of copies independently downloaded or shared by others. Withdrawal does not affect the lawfulness of earlier consent-based processing. Limited records may be kept where a separate lawful basis justifies them, as explained in our Privacy Policy.

Cairnova reserves the right to decline, remove or not publish any submission at our sole discretion and without obligation to provide explanation. We will not publish content that is offensive, misleading, in breach of third-party rights, or inconsistent with the Cairnova brand and community values.

By submitting content you confirm that: your submission does not infringe the intellectual property rights, privacy rights or any other rights of any third party; no identifiable individuals appear in your submission without their consent; and your submission does not contain any unlawful, defamatory or harmful material.

Location name and map pin. Both gallery submission forms require a location name and confirmed latitude and longitude for the place shown in your photo or video. You can select a search result, place or move a pin on the map, or confirm coordinates manually. A nearby place name may be suggested; you may select it or enter your own more descriptive name. Suggestions and map imagery may be approximate or out of date. Check the name and pin before submitting. Editing the name does not move the pin. The selected coordinates describe the location you submit; the forms do not continuously track your movements.

Public gallery location information. If your submission is published, its location name, map position and associated coordinates may be made publicly available with the image or video, caption and contributor credit, including through the gallery map and gallery data used to display it. Visitors may be able to read or extract the exact submitted coordinates even when the page shows a place name. Submit only locations and descriptions that are suitable for public sharing. Do not disclose another person's private address or a sensitive location without appropriate permission. Your submission email address and internal consent records are not included in the public gallery listing.

Moderation and location corrections. We use the submitted name and coordinates to review entries, suggest a gallery browsing region, group content geographically and display published entries on the map. Region suggestions are approximate and may be corrected during review. A location being shown in the gallery does not establish a right of access or confirm that it is safe to visit. Contact [email protected] to request a correction or removal of location information; personal data requests are addressed under Section 9.

To the fullest extent permitted by law, Cairnova Commerce Ltd, its directors, employees, partners and agents exclude all liability for:

Nothing in these Terms limits our liability for death or personal injury caused by our own negligence, fraud, or any other liability that cannot be excluded by law.

Any financial limitation in this clause applies only where permitted by law and does not apply to the liabilities listed in Clause 7.2 or restrict your statutory consumer rights. Subject to those exclusions, our total liability to you in connection with a claim shall not exceed the amount you paid to us in the 12 months preceding the claim, or £100, whichever is greater.

All content on cairnova.co.uk — including text, imagery, brand assets, intelligence data presentation, design and code — is the intellectual property of Cairnova Commerce Ltd unless otherwise stated.

Except as permitted by Clause 8.7 or an applicable third-party licence, you may not reproduce, distribute, modify or commercially exploit any content from our website without our prior written consent.

The Cairnova name, logo and brand marks are proprietary to Cairnova Commerce Ltd. Unauthorised use is strictly prohibited.

Copyright in the original design, source code, layout, structure and written content of cairnova.co.uk arises automatically upon creation under the Copyright, Designs and Patents Act 1988, and subsists whether or not formally registered or marked with a copyright notice. This Clause 8.4 is provided for clarity and as an additional express statement of that automatic protection — it does not create any right that does not already exist in law.

Cairnova Commerce Ltd is the owner of that copyright. Any unauthorised copying, scraping, reproduction, adaptation or repurposing of our website's design, source code or original content — in whole or in part — without our express prior written permission may result in legal action to protect our rights.

All rights not expressly granted to you under these Terms are reserved by Cairnova Commerce Ltd.

Personal use of downloadable GPX files. Where we provide a GPX download, you may download it, retain a copy, import it into your navigation app or device and adapt it for your own personal, non-commercial route planning, subject to Section 3 and any applicable source-data licence or attribution requirements. This permission does not authorise you to describe the route as field-verified, safe or endorsed by Cairnova. Rights granted by an applicable third-party or open-data licence remain unaffected.

Our Privacy Policy, available at cairnova.co.uk/privacy, explains how we collect, use and protect your personal data. The Privacy Policy provides information about our handling of personal data; accepting these Terms does not itself constitute consent to every form of personal data processing.

We use session data and analytics to improve our services. We do not sell your personal data to third parties.

Submission and location data we keep. We store your submitted location name, latitude, longitude and assigned gallery region alongside your content, caption, name, email address, optional social media handle and submission consent record. Consent records include the recorded wording, timestamp and submitting IP address. We use this information to administer and moderate submissions, manage publication and credit, organise the gallery map, communicate about submissions, and deal with corrections, rights requests or disputes. Public and private information are distinguished in Clause 6.9.

Retention. We retain submission information, including its location, for as long as reasonably necessary to review and administer the submission and, where published, maintain its gallery feature and related permitted uses. Retention is assessed by reference to whether the submission remains under review or in use, whether a correction, removal request or dispute is outstanding, and whether records are needed to demonstrate permissions or meet legal obligations. Ending a Pick of the Month feature or removing an entry from public display does not, by itself, delete the underlying submission, coordinates or private media archive. Information no longer needed for these purposes should be deleted or anonymised; these Terms do not authorise indefinite retention merely because a submission was made.

Corrections, removal and data protection rights. Contact [email protected] to request a location correction, removal from public display, or exercise applicable rights over your personal data, including access, rectification or erasure. Requests are assessed under applicable data protection law and its time limits; some information may need to be retained where a lawful exception applies. Where processing relies on consent, you may withdraw that consent without affecting the lawfulness of earlier processing. These rights are separate from the content licence arrangements in Section 6. Publicly downloaded copies and third-party caches may not disappear immediately when content is removed from Cairnova. You may also raise a concern with the Information Commissioner's Office (ICO).

Our website may contain links to third-party websites and services. Cairnova is not responsible for the content, accuracy or practices of any third-party website.

Weather data is provided by Open-Meteo (open-meteo.com) and NOAA. Aurora and geomagnetic data is provided by the NOAA Space Weather Prediction Center. Cairnova does not warrant the accuracy of data provided by these services.

Individual event pages include an embedded Google Maps view of the event location. Location markers are generated automatically from the location text provided at submission, and Cairnova does not warrant the accuracy of the map, the pin placement, or any information displayed by Google's mapping service.

Interactive route maps may use OpenStreetMap data and Esri basemap services. OpenStreetMap data is made available under the Open Database Licence and is attributed to OpenStreetMap contributors. Esri basemaps and imagery remain subject to Esri's terms and applicable data-provider attribution. Mapping attribution displayed with a map forms part of these Terms and must not be removed or obscured.

GPX Studio may be used as a technical editing tool when preparing route files. Reference to a third-party tool, mapping provider or information source does not imply that it has verified, approved or endorsed Cairnova or any Cairnova route.

Submission maps and place-name searches. The gallery submission forms use Mapbox satellite mapping and Photon place-name search based on OpenStreetMap data. Opening the map connects your browser to the mapping provider, which may receive technical information such as your IP address, browser information and map requests. Using place search sends your search text to the location-search provider through our website; placing or moving a pin can send the selected coordinates to that provider to suggest a nearby name. A suggested name is optional and does not verify the location. These providers have their own terms and privacy information, and mapping attribution must remain visible.

Gallery media storage. We use Cloudflare R2 to store gallery photos and videos and deliver published media. Unpublished uploads and retained originals are held in private storage for moderation and administration; approved display copies are made publicly accessible for the gallery. Private originals may remain stored after publication, subject to the retention principles in Section 9. Cloudflare and our website hosting provider process relevant files and technical requests to provide these services. Location and submission details are also retained in the website database. This storage arrangement does not transfer ownership of your content to Cairnova or grant an additional advertising licence.

We do not guarantee that our website or any service will be available at all times. We may suspend, withdraw or restrict access to any part of our website for operational, business or security reasons without notice.

Intelligence data is updated on a best-efforts basis. We do not guarantee the frequency, timeliness or continuity of data updates.

We reserve the right to update these Terms at any time. Changes will be published on this page with an updated effective date. Your continued use of our website following any changes constitutes acceptance of the revised Terms.

We recommend checking this page periodically. Significant changes will be communicated via our newsletter where possible.

These Terms are governed by and construed in accordance with the laws of Scotland. Any disputes arising from these Terms or your use of our website shall be subject to the exclusive jurisdiction of the Scottish courts.
